Fashion and beauty e-commerce platform Nykaa has sued its former chief business officer Gopal Asthana, accusing him of breaching privacy and misusing the brand's data, which could cause harm to the company. Asthana is currently heading Tata's fashion e-commerce platform Tata CLiQ.

Nykaa filed a petition in the Bombay High Court
Nykaa, in its petition in the Bombay high court, said it has adequate remuneration for its former chief business officer, including long-term incentives and stock optionThe company asked for a refund 19 crore employee stock options and A penalty of Rs 5 crore has been imposed for impairment of goodwill and other business remedies, the report said.
It said the beauty brand has requested the court to restrain Asthana from using Nykaa's data for Tata CliQ's business. On Wednesday, the high court passed an interim order asking him not to hire employees from Nykaa to Tata CliQ. However, Nykaa has not made Tata CliQ a part of the case.
Asthana worked as the chief business officer at Nykaa for four years and was on the company's board. Nykaa has alleged that due to his position, Asthana had access to private and confidential data of the company.
The Falguni Nayar-led brand also allowed its former chief business officer to join a rival company despite a non-compete agreement. The report quoted Asthana as saying that the allegations are “false and will be proven in the arbitration.”
He said, “However, since the matter is sub-judice, I cannot comment on it. This matter is between my former employer and me, and my current employer is not a party to the case, so it is better not to discuss it.”
However, Nykaa or Tata CliQ did not comment on the report. Asthana will join Tata CliQ in 2023. Competitors in the space include Nykaa, Tata CliQ, Amazon Fashion, Reliance's Ajio and Tira and Flipkart's Myntra.
